What happens if…

An estate plan means your family and friends won’t have to guess your wishes. You can control what happens with your assets after your death. It may also keep your estate out of probate, helping ensure your goals are fulfilled by a person you choose of your choosing – transferring assets to the persons you have identified to receive them.

WILLS

The administration of a will has a level of monitoring by the Court.  When heirs are not trusting of each other, court supervision may be desirable because the Executor will need to prepare an Inventory of all assets owned solely by the decedent at death.  At the end of the administration, the Executor will have to satisfy the Court &/or heirs that assets have been distributed pursuant to the terms of the Will.

TRUSTS

With a trust, you put your assets in the name of the trust and then you or another person you choose manages those “trust assets”. At your death, the Trustee will administer the trust assets pursuant to the terms of the trust. The responsibilities of the Trustee and his obligation to the beneficiaries will be clearly identified. Unlike probate, the trust is generally private and not supervised by the Court.

We listen every day to relatives of individuals who are going to be discharged from a hospital, but are not well enough to return home.

Our clients live in or are relocating to Kentucky and Indiana – states which each have very different Medicaid rules. Many of our clients have family and friends in both states. So, when they leave the nursing home they frequently have questions: Where do they go? What do they do? How do they pay?

We are qualified to discuss the pros and cons of deciding if, all facts considered, one state is the better choice in order to qualify for Medicaid. Timing of this decision is especially critical for a married couple.

The Aid & Attendance Pension is the non-service related benefit most frequently requested by our clients because it helps the family afford to keep the veteran at home with qualified help for a longer time. Additionally, it may be easier to qualify for than Medicaid.

Peggy Timmel

Attorney

Peggy is licensed to practice law in both Kentucky and Indiana. Since her admission to the Kentucky Bar in 1987 (admitted in Indiana in 2004), she has held a variety of positions that have allowed her to use her education including: corporate counsel, trust counsel, trust administrator and associate in private practice, and administration of estates and trusts.

Peggy recognizes that many of her clients have needs far greater than legal when dealing with planning for aging or debilitating conditions: Spirituality/Purpose, Housing, Health and Wellness, Life Enrichment/Dignity, Financial Planning, and Bereavement. She has developed affiliations with numerous professionals able to address these areas of concern.

Jessica Richards

Jessica grew up in Louisville and has lived in the area most of her life. She currently lives in the Highlands with her husband, a New Albany native, and their two daughters.  Jessica earned her undergraduate degree in Telecommunications from the University of Kentucky, and graduated cum laude from the University of Louisville Brandeis School of Law. While in law school, Jessica participated in Moot Court, served as a Research Assistant, and was an Editor for Law Review.  Jessica is licensed to practice law in both Indiana and Kentucky.

As the daughter of a veteran, one of her first goals when joining Timmel Associates was to obtain her Veterans Affairs accreditation. Jessica is passionate about helping veterans receive the benefits that they deserve.
