Estate Planning
Estate Planning
What happens if…
An estate plan means your family and friends won’t have to guess your wishes. You can control what happens with your assets after your death. It may also keep your estate out of probate, helping ensure your goals are fulfilled by a person you choose of your choosing – transferring assets to the persons you have identified to receive them.
WILLS
The administration of a will has a level of monitoring by the Court. When heirs are not trusting of each other, court supervision may be desirable because the Executor will need to prepare an Inventory of all assets owned solely by the decedent at death. At the end of the administration, the Executor will have to satisfy the Court &/or heirs that assets have been distributed pursuant to the terms of the Will.
vs.
TRUSTS
With a trust, you put your assets in the name of the trust and then you or another person you choose manages those “trust assets”. At your death, the Trustee will administer the trust assets pursuant to the terms of the trust. The responsibilities of the Trustee and his obligation to the beneficiaries will be clearly identified. Unlike probate, the trust is generally private and not supervised by the Court.
Timmel Associates is here to help you protect the proper transfer of your assets to those you love.
Consider
- Do your heirs get along with each other? (Are they influenced by others who may instigate problems?)
- Do you want your estate to be private?
- Do your heirs need asset protection?
- Do your heirs have circumstances that they need protection?
- Assets held in your individual name require some type of administration at your death.

Asset Protection
Asset Protection
You’ve seen the ads:
“Don’t let a nursing home take all your assets.”
At Timmel Associates we consider more than just the bottom line of your assets when setting up your plan to maximize the options available to pay for your care as circumstances change. Some plans involve estimating the cost of care for a projected number of months and identifying the source of payment.
Consider
- Did your ancestors need assistance with activities of daily living in their last months/years of life?
- Will family member or friends be available and reliable to help with care?
- Do you need to preserve assets for a spouse or disabled child?
“Timmel Law is not only expert and diligent, but also personable, down-to-earth and genuine. They have been instrumental in helping our family through complex and challenging circumstances; specifically with our elderly parents regarding medical costs, estate planning, assisted living and access to a new benefit with the VA. Without hesitation, I recommend Timmel Law.”
We can help you protect your assets and loved ones.
Long-term Care & Medicaid
Long-term Care & Medicaid
Where do they go?
What do they do?
How do they pay?
We listen every day to relatives of individuals who are going to be discharged from a hospital, but are not well enough to return home.
Our clients live in or are relocating to Kentucky and Indiana – states which each have very different Medicaid rules. Many of our clients have family and friends in both states. So, when they leave the nursing home they frequently have questions: Where do they go? What do they do? How do they pay?
We are qualified to discuss the pros and cons of deciding if, all facts considered, one state is the better choice in order to qualify for Medicaid. Timing of this decision is especially critical for a married couple.
While families attend to the needs of their loved ones in need of long term care, we guide them through the many steps necessary to create a plan that may also protect assets for the spouse, a disabled child, or other family members still living in the community, while maximizing financial and care opportunities.
Consider
- How critical is the price of long term care?
- What locations are preferred for long term care services?
- Do you have long term care insurance to help with the cost of care?
“We have utilized Timmel Law for several different legal matters over the years including Estate Law, Elder Law, Family Law, and Wills & Trusts. We can’t imagine having anyone else service our needs. We highly recommend Peggy Timmel and Timmel Law for your legal needs.”
Timmel Law will help you navigate these vital decisions.
Veterans Benefits
Veterans Benefits
Explore your VA benefit eligibility.
As attorneys certified to practice by the Veterans Administration and daughters of veterans, we are honored to consult with veterans and their families to explore eligibility for benefits through the VA.
The Aid & Attendance Pension is the non-service related benefit most frequently requested by our clients because it helps the family afford to keep the veteran at home with qualified help for a longer time. Additionally, it may be easier to qualify for than Medicaid.
More importantly, we know how to qualify for the benefit without interfering with the possible need for Medicaid assistance in a long term care facility.
Timmel Associates would count it a privilege to help you and your loved ones explore your VA benefit eligibility. Please give us a call so we can help you gain the VA benefits you so richly deserve.

Probate & Estate Administration
Probate and Estate Administration
If you don’t have legal documents – you need them.
If you are injured or have a serious illness, who will make medical decisions for you and who makes financial decisions to manage your stuff and pay your bills?
Maybe you simply need to update your current documents.
At Christmas 2016, Peggy gave her 20-something nieces and nephews Powers of Attorney and Health Care Directives with Living Will provisions as gifts, showing just how important we think it is for everyone to have these documents.
I know when I go through Timmel Law things will get taken care of. I have always had a great experience and every family that I have referred have also said the same thing.
